Brunswick and its US divisions and subsidiaries (hereinafter collectively known as “Brunswick”) are in the process of certifying to the U.S. Department of Commerce Safe Harbor program relating to the European Directive on Data Protection (see: http://www.export.gov/safeharbor).
For purposes of this Privacy Statement, “Personal Information” means information that (i) is recorded in any form, (ii) is about, or relates to, an identified or identifiable consumer or customer, and (iii) can be linked to that consumer or customer. This Privacy Statement outlines our policy and practices for implementing the Safe Harbor privacy principles for online and offline Personal Information.
Brunswick’s policy regarding the collection, storage, transfer, use and other processing of Personal Information is to comply with the Safe Harbor principles of notice, choice, onward transfer, access, security, data integrity, and enforcement and oversight.
It is Brunswick’s policy to notify our consumers and customers located in the EEA about the purposes for which we collect and use Personal Information, the types of third parties to which we disclose the information, the choices consumers and customers have for limiting the use and disclosure of their information, and how to contact us about our practices concerning Personal Information.
In the course of its relationship with customers and/or consumers, Brunswick may collect certain Personal Information such as name, email address, postal address and telephone number. It is Brunswick’s policy to not collect sensitive Personal Information, such as information about medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or other sensitive information as defined by the Safe Harbor framework.
We may use Personal Information (i) to respond to your requests; (ii) to evaluate the quality of our products and services; (iii) to help us understand your purchasing habits and needs; (iv) to communicate with you about our products and services; (v) to inform you about, and allow you to participate in, our offers, contests and other promotions or events; (vi) for internal administrative, analytics and compliance purposes; (vii) to manage consumer warranty claims, consumer complaints, consumer technical support and product safety notifications; and (viii) to comply with our legal obligations.
Brunswick discloses Personal Information to Brunswick subsidiaries and affiliates, and with Brunswick business partners in order to perform tasks on behalf and under the instructions of Brunswick as described in the “Onward Transfer of Personal Information” section. It is Brunswick’s policy to not use Personal Information for purposes incompatible with the purposes for which the information was originally collected without notifying the relevant individuals of such uses and offering an opportunity to opt out. It is Brunswick’s policy to provide consumers and customers located in the EEA with an opportunity to opt out of sharing Personal Information with other third parties. In addition, we may disclose Personal Information (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials based on an enforceable government request or as may be required under applicable law, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.
We may share Personal Information with service providers we have retained to perform services on our behalf. We are in the process of implementing Safe Harbor requirements with respect to sharing Personal Information with our service providers.
Brunswick provides consumers and customers located in the EEA with reasonable access to the Personal Information the company maintains about them. We also provide a reasonable opportunity to correct, amend or delete that information where it is inaccurate. We may limit or deny access to Personal Information where providing such access is unreasonably burdensome or expensive under the circumstances, or as otherwise permitted by the Safe Harbor principles. To obtain access to Personal Information, you may contact Brunswick by email, telephone or in writing, as specified in the “How to Contact Us” section of this Policy.
Brunswick maintains reasonable administrative, technical and physical safeguards to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction.
Brunswick takes reasonable steps to ensure that Personal Information it collects is relevant for the purposes for which the information will be used and that the information is reliable for its intended use and is accurate, complete and current. We depend on our consumers and customers to update or correct their Personal Information whenever necessary.
Consumers and customers located in the EEA may file a complaint with our Privacy Officer in connection with Brunswick’s processing of their Personal Information. If the complaint cannot be resolved through our internal process, it shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Judgment on any award rendered by the arbitrator(s) may be entered in any court having jurisdiction.
